Harold J. Rosenthal

Hal joined Ostroff, Hiffa and Associates in the fall of 2011 after over thirty years as an attorney with the New York State Department of Health. As Director of the Bureau of Litigation and prior to that as the senior staff attorney, he coordinated the representation of the Department of Health in federal and state court litigation with a special focus on health facility regulation and restructuring and Medicaid reimbursement; and provided advice and counsel to Department officials as to possible actions to avoid anticipated litigation, to minimize any adverse impact of ongoing litigation and to comply with judicial decisions. Hal worked closely with staff of the Office of the Attorney General, the Governor's Office, Division of the Budget and other State agencies in developing litigation strategy and responses.

Hal brings with him a broad range of knowledge and experience with the structural and financial challenges facing New York State health care programs in an ever changing federal and state regulatory environment.

He participated in the implementation of and oversight of the defense of the recommendations of the New York State Commission on Health Care in the 21st Century (Berger Commission), and the representation of the Department in numerous complex health system, hospital and nursing home bankruptcy proceedings. He also oversaw Medicaid reimbursement litigation addressing compliance with federal and state requirements with regard to hospital, nursing home and clinic reimbursement rate setting methodologies.

He is a graduate of Temple University School of Law and earned his Bachelor degree from the University of Michigan.
